Terms of Service

1. Acceptance of Terms

By accessing or using Aperi (“the Service”), operated by Aleksander Stós Digital Technologies, NIP PL9930677569, Hoża 51, 00-681 Warsaw, Poland (“we”, “us”, or “our”), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Aperi is a daily question app for couples that delivers personalized conversation prompts. The Service includes the Aperi apps for iOS and Android, the getaperi.com website, the content delivered through them, and related features.

3. Eligibility

You must be at least 16 years old to use the Service. By using Aperi, you represent that you meet this age requirement.

4. Account Registration

You may need to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

5. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Harass, abuse, or harm another person through the Service
  • Attempt to gain unauthorized access to our systems
  • Reverse-engineer, decompile, or disassemble the Service
  • Scrape, crawl, or use automated means to access the Service without permission
  • Impersonate any person or entity

6. User Content

You retain ownership of any content you submit (such as answers to questions). By submitting content, you grant us a non-exclusive, worldwide license to use, store, and process it for the purpose of providing and improving the Service.

7. Intellectual Property

All content, features, and functionality of the Service — including questions, algorithms, design, and branding — are owned by Aperi and are protected by intellectual property laws.

8. Subscriptions and Payments

Some features require a paid subscription (Aperi Premium). Aperi Premium is offered as an auto-renewable monthly or yearly subscription, and as a one-time lifetime purchase. The exact price, billing period, and any introductory or trial terms for your region are shown in the app before you confirm the purchase.

Payment is charged to your Apple ID or Google Play account at confirmation of purchase. An auto-renewable subscription renews automatically for the same period at the same price unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.

You can manage your subscription and turn off auto-renew at any time after purchase: on iOS at apps.apple.com/account/subscriptions, and on Android at play.google.com/store/account/subscriptions. Cancelling stops future renewals and you keep access until the end of the period you have already paid for. If a free trial is offered, any unused portion of the trial is forfeited when you buy a subscription. Refunds are handled by the store that processed the payment, in accordance with applicable law and that store’s policies.

9. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may delete your account and its data at any time from the app settings, or by following the steps on our account deletion page. Deleting your account does not by itself cancel a subscription bought through the App Store or Google Play; cancel that separately using the links in section 8.

10. Disclaimer of Warranties

The Service is provided “as is” without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the maximum extent permitted by law, Aperi shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service.

12. Governing Law

These Terms are governed by the laws of the European Union and the applicable member state where we operate. Any disputes shall be resolved in the competent courts of that jurisdiction.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on the Service. Continued use after changes constitutes acceptance.

14. Apple App Store

These Terms apply to your use of Aperi on Apple devices, and the following applies in addition to everything above.

  • These Terms are between you and Aleksander Stós Digital Technologies only, not with Apple. We, not Apple, are solely responsible for Aperi and its content.
  • We grant you a non-transferable licence to use Aperi on any Apple-branded product that you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
  • We, not Apple, are solely responsible for any maintenance and support for Aperi. Apple has no obligation to furnish maintenance or support.
  • In the event of any failure of Aperi to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to Aperi.
  • We, not Apple, are responsible for addressing any claim relating to Aperi, including product liability claims, any claim that Aperi fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
  • We, not Apple, are responsible for the investigation, defence, settlement and discharge of any third-party claim that Aperi infringes that third party’s intellectual property rights.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • You must comply with any applicable third-party terms of agreement when using Aperi.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.

15. Google Play

These Terms apply to your use of Aperi on Android devices, and the following applies in addition to everything above.

  • These Terms are between you and Aleksander Stós Digital Technologies only. Google is not a party to them, is not responsible for Aperi or its content, and has no liability under them.
  • Your use of Google Play is separately governed by the Google Play Terms of Service, which are between you and Google.
  • Purchases made inside Aperi on Android are processed by Google Play. Google is the payment processor, and the record of the transaction appears in your Google Play order history.
  • You can view, manage, and cancel a subscription at any time at play.google.com/store/account/subscriptions. Cancelling stops future renewals and you keep access until the end of the period you have already paid for.
  • Refunds for purchases made through Google Play are issued under Google Play’s refund policy and applicable law. Consumers in the European Union and other jurisdictions may have additional statutory rights, which these Terms do not limit.
